Cancellation and Refund Policy
Buildclaw operates as a business and we expect clients to understand and respect our policies. Our goal as a web design and internet marketing company is to bring the highest value per dollar spent by our clients, and in order to help us in that pursuit, we need to cover expenses and fuel our operations. Therefore, we require you to pay 50% of the total fee upfront before initiation of the website in respect to the package you have selected.
We understand that sometimes “life happens” and you may need a refund on fees paid for services to Buildclaw. We strive to be fair and create a policy that is a win-win for both parties. We will work with you to make you satisfied with our work. However, if a refund is requested and granted, all property created by Buildclaw, including graphics, content, and code, will remain the property of Buildclaw.
Requests for the final portion of payment due on all projects will not be made until the project receives final approval from the client. Final payment is due within 5 business days after the project has been approved by the client.
If you wish to cancel your orders placed at Buildclaw, you can do so within 15 days of the orders placed. In this case, any client who is not satisfied with our services can request a refund within 15 days from the date of the first installment. The refund will be made after deducting the service tax and the hourly charges for the work completed by us.
If paid by credit card, refunds will be done to the credit card number provided at the time of purchase, and in case of debit card/net banking payments, the refund will be made to the same account.
No refund will be given if:
- You have already approved the design mockup. This condition will not apply if we are unable to complete the project as per the project's specifications.
- The project delays are caused by lack of communication from your end.
- If the project is completed and deployed on the server, no refunds will be done.
By signing up for our services, you acknowledge that you have read and understand this Agreement and agree to be bound by its terms and conditions.
Web Design and Development
At Buildclaw, we understand that web design and development projects require significant resources, time, and internal expenses. To ensure fairness and efficiency for both our clients and our team, we request payments for custom design projects (such as website designs, individual page mockups, smaller design components within a website, enhancements, additional pages, and logo design) in increments. We also offer discounts for those who agree to pay in full.
However, if a project is cancelled, delayed, or postponed by the client, we retain a portion of the amount as it represents work already completed. We do this as a courtesy to our clients and to cover the expenses incurred by our team.
Please note that all completed projects, as defined by the scope of work agreed upon, are non-refundable. In the event that a client has only paid 50% of the project cost as a down payment, but the project is more than 85% complete, the client must pay the full agreed-upon amount to Buildclaw if the project is cancelled or if the client does not respond within 30 days of completion. We regret that no refunds can be given in this scenario.
Themes, Templates and Scripts.
Our refund policy for themes, templates, and scripts is as follows: If you encounter any of the following situations after downloading an item, you are eligible for a 50% refund:
- You bought an item by mistake
- You do not have sufficient expertise to use the item.
- The item did not meet your expectations or you feel the item is of low quality
- You can no longer access the item because it has been removed or the author who previously provided the item is no longer active on our platform (We advice you download the item as soon as you purchase them to avoid this situation).
Please note that we do not provide refunds if you have downloaded an item and are satisfied with its quality and functionality or if you do not provide sufficient information as to why you are entitled to a refund.
Domain & Hosting Service
At Buildclaw, payments made for web hosting and domain name services are considered final and non-refundable. When a customer places an order for web development services, their account is promptly set up and allocated a specific amount of server resources based on the chosen plan.
Chargebacks
At Buidclaw, we require our clients to provide their credit card information in order to process payments for services rendered. Alternatively, we can send an invoice for payment from the client’s end. It is considered fraudulent and illegal to claim that you did not provide your card information or were unaware of such charges.
In the event that we receive a chargeback or payment dispute from a credit card company or bank, your service or project will be suspended without notice. To recover fees passed on to us by the credit company, a chargeback fee of ₦5000 will be issued, in addition to any outstanding balances accrued as a result of the chargeback(s). Payment of the total outstanding balance and chargeback fee is required before service can be restored, files delivered, or any further work is done. We strongly encourage clients to contact us to address any billing issues instead of requesting a chargeback or opening a transaction dispute, which is considered fraudulent and illegal. Please read and fully understand our refund policy before making any payment(s).
At Buidclaw, we reserve the right to disable and/or terminate a user’s account if they are found to be in violation of our terms of service. In such cases, accounts terminated due to policy violations will not be eligible for refunds.
